Conveyancing Forms Update

The Law Society is launching revised versions of the TA6 Property Information Form, TA6 Explanatory Notes for Sellers and Buyers and TA7 Leasehold Information Form, details of the changes can be found here: Transaction (TA) forms | The Law Society.

All forms are now available for immediate use although previous versions will be accepted until 25th June 2024 at which point the updated versions must be used.

UPDATED! TA7 Leasehold Information Form and TA13 Completion Information and Undertakings Form

NOW AVAILABLE FOR IMMEDIATE USE.

The Law Society has updated the following forms:

TA7 Leasehold Information Form (3rd Edition) (01/23)
TA13 Completion Information and Undertakings Form (01/23)

The Law Society advises that the TA7 Leasehold Information Form (3rd Edition) (2023) includes:

  • A new section on building safety to enable compliance with the Building Safety Act 2022 including questions about: remediation works; whether the lease is a qualifying lease; the Leaseholder Deed of Certificate and the Landlord’s Certificate.
  • A question asking if the seller knows about defects that create a building safety risk.
  • New questions about the ownership and management of the building.
  • Fields to capture details of the seller if they are a company.
  • Updated definitions and other process improvements.

 
The TA13 Completion Information and Undertakings (4th Edition) (2023) includes provisions for:

  • Arrangements to be made for the seller to hand over not just the keys, but also any equivalent electronic devices, passcodes and alarm codes.
  • Confirming that a copy of the executed transfer is attached or will be supplied before completion.
  • A client firm’s reference to be included with the bank details.

 
Both forms may be used from 9th January 2023 but the official ‘use’ date is 14th February 2023.

UPDATED! CON29DW Drainage and Water Enquiries

 In order to reflect legislative and industry change, the Law Society, in conjunction with the Drainage and Water Searches Network (DWSN), have developed a commercial drainage and water enquiry (CON29DW Commercial). This development has created a standardised enquiry that validates valuable information regarding, inter alia, wayleaves and easements. Accordingly, the ‘existing’ CON29DW, should now be used for residential enquiries only whilst the new CON29DW Com will be used for commercial enquiries.

The two separate forms, CON29DW (for residential properties) and CON29DWCom (for commercial properties), are available now for immediate use.

The Law Society has updated TA6 and the accompanying guidance notes. Please review the updated guidance notes for all changes, however The Law Society advises that the changes deal with updated guidance from the Government about the discharge of septic tanks into surface water.

The Law Society has updated the following forms which should be used after 31st January 2020.

TA6(N) Law Society Property Information Form (TA6) - Explanatory Notes for Sellers and Buyers 2/20

The Law Society advises that changes to the Japanese knotweed question include:

  • Highlighting that information ought to be provided to a buyer if the seller is aware that there is a treatment plan in place
  • Rewording the introduction to better explain what knotweed is
  • Largely replacing ‘eradication’ with ‘managing its regrowth’ given the nature of knotweed
  • Guidance notes now refer to knotweed within 3 metres of a property rather than using the current 7 metres adopted by most surveyors which has come under criticism as being overly cautious and causing a significant number of properties to be otherwise ’blighted’.

UPDATED! TA13 Completion Information and Undertakings (Third Edition)

The Law Society has updated the following form which should be used from 1st May 2019.

The changes have been made further to a revision to the Code for Completion which has been amended to clarify the position following the Court of Appeal ruling in Dreamvar last year. The Law Society has postponed the implementation date for the updated SCS1 and SCPC from 01 March 2018 to 23 March 2018. The forms will be made for purchase as soon as The Law Society confirm the new implementation date and approve the forms.

UPDATED! CON29 FORMS

The Law Society has amended CON29O and CON29R to include questions for use from 04 July 16.

Any forms received on or before 01 July 2016 will receive a response on the current form. If a form us received on or after 02 July the local authority will decide whether to reply on the current or new version.

The CON29DW has also been updatd to include questions about private pumping stations, sustainable drainage systems and replaces water quality information with water hardness information.

ALL CON29O, CON29R AND CON29DW FORMS SUBMITTED ON OR AFTER 04 JULY 2016 MUST BE THE NEW VERSION.

Please be aware that the decision to charge VAT on CON searches has been delayed and no longer comes into force on 04 July 2016.

Updated versions of the CON29 forms are now available to purchase through our website.

Amendments to Assured Shorthold Tenancy Agreements

The Immigration Act 2014 introduced an obligation on landlords to ensure that all prospective tenants have the right to rent by virtue of their immigration status. The following forms have all been amended to make provision for these changes and are available for immediate purchase: 

  • AGR1F - Assured Shorthold Tenancy Agreement (Furnished Flat)
  • AGR1U - Assured Shorthold Tenancy Agreement (Unfurnished Flat)
  • AGR2F - Assured Shorthold Tenancy Agreement (Furnished House)
  • AGR2U - Assured Shorthold Tenancy Agreement (Unfurnished House)

NEW LEASEHOLD PROPERTY FORMS

The Law Society, in conjunction with trade associations across the legal and leasehold sectors has revised the Leasehold Property Enquiries form LPE1. Trade associations involved included the British Property Federation, the Royal Institution of Chartered Surveyors and the Association of Residential Managing Agents.
The second edition of the LPE1 form was released on 1st October 2015 along with the introduction of a Buyers Leasehold Information Summary (LPE2).
The amendments have been made to:

  • Reflect changes in the Association of British Insurer agreements with lenders;
  • Provide better definitions and general wording; and
  • Include new questions aimed to reduce the need for additional enquiries, for example with regard to any transfer fees payable on sale.

WITHDRAWN! Land Charges form

Land Charges form ‘K5 – Deed of Arrangement’ is withdrawn following the repeal of the Deeds of Arrangement Act 1914. As from 1 October 2015 it is no longer possible to register a new deed of arrangement.

Background: The Deeds of Arrangement Act 1914 has been repealed by virtue of paras. 1-3 of Sch.6 to the Deregulation Act 2015). The relevant provisions relating to Deeds of Arrangement are in force as from 1 October 2015 (by virtue of para.2(e) of The Deregulation Act 2015 (Commencement No.3 and Transitional and Saving Provisions) Order 2015 (SI 2015/1732)).

LANDLORD AND TENANT - USE FROM 01 OCTOBER 2015

LT6A - Notice seeking possession of a property let on an Assured Shorthold Tenancy, Housing Act 1988, section 21(1) and (4)

Due to the commencement of The Assured Shorthold Tenancy Notices and Prescribed Requirements (England) Regulations (2015) a new prescribed form is available where possession of accommodation under an assured shorthold tenancy (AST) is sought under s21(1) or (4) of the Housing Act 1988.

The new form will become mandatory in England for any ASTs created on or after 01 October 2015.

The form may be used for all eligible ASTs created before 01 October 2015 but is not mandatory for the earlier tenancies.

Form LTA3E has had a slight amendment to reflect the introduction of the new form.

We understand that it is important for solicitors, local authorities and others to know when the new forms will be introduced so that you can plan budgets, resources and system changes accordingly.

In February, we said that we were aiming to launch the new forms in October 2014. We also said that we would keep all respondents updated about any changes to this proposed launch date.

We are keen to ensure that the new forms and the changes made to the forms are practicable. That is why we consulted the profession, local authorities and other key stakeholders in 2013. Following the publication of the consultation response, it was necessary to undertake further discussions with software developers, local authorities and others to ensure that the new forms were fit for purpose.

As a result of those further discussions, it has become necessary to delay the introduction of the new forms. We hope that the new forms will be launched in April 2015.

New enquiries - interim position

Some new enquiries have been added to the forms, eg community infrastructure levy (CIL) and assets of community value. While the forms will not go live yet, if solicitors wish to raise enquiries about these matters now, they should follow the format of the enquiry on the form to make it easier for respondents to answer.

Not all local authorities will have a CIL charging schedule. Solicitors may therefore wish to check the local authority's website for further information about whether a charging schedule is in place before raising enquiries about CIL.

Guidance

We are currently working on producing guidance notes to accompany the forms and propose to publish these to coincide with the introduction of the new forms.

Conveyancing and Landlord & Tenant Forms - Changes and New Additions

Form CON29DW has been updated following agreement amongst water companies for a new format of questions. This format includes the introduction of a summary sheet and an updated structure, which groups the CON29DW questions into four sections: Maps, Drainage, Water, Charging.

Changes to forms HRF1, HRF2W, HRF4B, HRF4C and HRF7W have been made to reflect the abolition of Rent Assessment Committees in England. Former HRF2 and HRF7 are now for use in Wales only.

Customers who deal with conveyancing in the social housing sector have requested the Right to Acquire forms to be added alongside the Right to Buy range, and these are now available. Ask for RTA1, RTA2 and RTA3.

Companies House has made changes to the following forms which are for use from 7 May 2012. Companies House has said that whilst previous versions of the forms will be accepted for a time if correctly completed, it is strongly recommended that the latest version is used wherever possible.

The following forms which are in both Conveyancing and Company form groups have been updated. HMRC has requested changes to the certificates on page 2 of these forms. HMRC announced that the existing version of the form will be accepted until 5 September 2012, although it is recommended that the new form is used for all transfers on or after 6 April 2012. Where the old version of the form is being used for a transfer which is otherwise exempt from stamp duty or for which no chargeable consideration is given, either add the certificate manually to the reverse of the form and complete and sign it or provide the Registrar with further details, including relevant supporting documentation, about the transfer and why it is exempt from stamp duty.

Conveyancing: Official update for 1 April 2011
 
The Law Society has produced a fifth edition of the Standard Conditions of Sale, for use from 1 April 2011, and form SCS has been amended to include the fifth edition. Changes have also been made to form TA13, for use from 1 April 2011. The Guidance notes for the fifth edition of the Standard Conditions of Sale are available on request.
