Following an extensive consultation period, the Law Society has today announced a new two-form approach to replace the 5th edition of the TA6 form. There will be an extended implementation period for the new forms, beginning in October 2025 before compulsory adoption of the new forms in March 2026. We have today received confirmation from the Law Society of England and Wales that the 4th and 5th editions of the TA6 property information form will continue to be accepted beyond the 15th January 2025. This extension is to allow sufficient time for full consideration of the results of the consultation before any further decisions are made. We will continue to keep you informed of any further developments when they become available.

In order to reflect legislative and industry change, the Law Society, in conjunction with the Drainage and Water Searches Network (DWSN), have developed a commercial drainage and water enquiry (CON29DW Commercial). This development has created a standardised enquiry that validates valuable information regarding, inter alia, wayleaves and easements. Accordingly, the ‘existing’ CON29DW, should now be used for residential enquiries only whilst the new CON29DW Com will be used for commercial enquiries.

The Law Society has amended CON29O and CON29R to include questions for use from 04 July 16.
Any forms received on or before 01 July 2016 will receive a response on the current form. If a form us received on or after 02 July the local authority will decide whether to reply on the current or new version.
The CON29DW has also been updatd to include questions about private pumping stations, sustainable drainage systems and replaces water quality information with water hardness information.
ALL CON29O, CON29R AND CON29DW FORMS SUBMITTED ON OR AFTER 04 JULY 2016 MUST BE THE NEW VERSION.
Please be aware that the decision to charge VAT on CON searches has been delayed and no longer comes into force on 04 July 2016.

The Immigration Act 2014 introduced an obligation on landlords to ensure that all prospective tenants have the right to rent by virtue of their immigration status. The following forms have all been amended to make provision for these changes and are available for immediate purchase:

The Law Society, in conjunction with trade associations across the legal and leasehold sectors has revised the Leasehold Property Enquiries form LPE1. Trade associations involved included the British Property Federation, the Royal Institution of Chartered Surveyors and the Association of Residential Managing Agents.
The second edition of the LPE1 form was released on 1st October 2015 along with the introduction of a Buyers Leasehold Information Summary (LPE2).

Land Charges form ‘K5 – Deed of Arrangement’ is withdrawn following the repeal of the Deeds of Arrangement Act 1914. As from 1 October 2015 it is no longer possible to register a new deed of arrangement.
Background: The Deeds of Arrangement Act 1914 has been repealed by virtue of paras. 1-3 of Sch.6 to the Deregulation Act 2015). The relevant provisions relating to Deeds of Arrangement are in force as from 1 October 2015 (by virtue of para.2(e) of The Deregulation Act 2015 (Commencement No.3 and Transitional and Saving Provisions) Order 2015 (SI 2015/1732)).

LT6A - Notice seeking possession of a property let on an Assured Shorthold Tenancy, Housing Act 1988, section 21(1) and (4)
Due to the commencement of The Assured Shorthold Tenancy Notices and Prescribed Requirements (England) Regulations (2015) a new prescribed form is available where possession of accommodation under an assured shorthold tenancy (AST) is sought under s21(1) or (4) of the Housing Act 1988.
The new form will become mandatory in England for any ASTs created on or after 01 October 2015.
The form may be used for all eligible ASTs created before 01 October 2015 but is not mandatory for the earlier tenancies.
Form LTA3E has had a slight amendment to reflect the introduction of the new form.

Following the publication of the consultation response, it was necessary to undertake further discussions with software developers, local authorities and others to ensure that the new forms were fit for purpose.
As a result of those further discussions, it has become necessary to delay the introduction of the new forms. We hope that the new forms will be launched in April 2015.

Form CON29DW has been updated following agreement amongst water companies for a new format of questions. This format includes the introduction of a summary sheet and an updated structure, which groups the CON29DW questions into four sections: Maps, Drainage, Water, Charging.
Changes to forms HRF1, HRF2W, HRF4B, HRF4C and HRF7W have been made to reflect the abolition of Rent Assessment Committees in England. Former HRF2 and HRF7 are now for use in Wales only.
Customers who deal with conveyancing in the social housing sector have requested the Right to Acquire forms to be added alongside the Right to Buy range, and these are now available. Ask for RTA1, RTA2 and RTA3.

Legal: Conveyancing and Company
The following forms which are in both Conveyancing and Company form groups have been updated. HMRC has requested changes to the certificates on page 2 of these forms. HMRC announced that the existing version of the form will be accepted until 5 September 2012, although it is recommended that the new form is used for all transfers on or after 6 April 2012. Where the old version of the form is being used for a transfer which is otherwise exempt from stamp duty or for which no chargeable consideration is given, either add the certificate manually to the reverse of the form and complete and sign it or provide the Registrar with further details, including relevant supporting documentation, about the transfer and why it is exempt from stamp duty.

The Family Procedure (Amendment) Rules 2012 come into force on 6th April 2012. The Ministry of Justice has made consequential amendments to a number of forms, and have also made changes following user feedback on some of the forms introduced under the Family Procedure Rules 2010.

The following forms have been updated. Forms N1, N1A and N149 have been revised by the Ministry of Justice in line with the 58th Update to the Civil Procedure Rules to facilitate the processing of work through the County Court Money Claims Centre and should be used from 19 March 2012 .

Old versions signed and dated on or before 2 October 2011 will be accepted until 1 November 2011 after which time they will be rejected.

The Companies Act 2006 (Annual Returns) Regulations 2011 comes into force on 1 October 2011, and as a result there are changes to the Annual Return form AR01. The new version must be used for returns made up to a date after 1 October 2011.
