Advance Information - Legal Aid 19/01/07
 
The Legal Services Commission have made changes to some of the Masterpack Forms.
 
The following forms can be used as soon as you receive them. The mandatory date for these forms is 2nd February 2007.
 
CDS14 Application for Legal Aid in Criminal Proceedings
CDS15 Financial Statement for Legal Aid in Criminal Proceedings
CDS16 Legal Aid in Criminal Proceedings: Application for Review on the Grounds of Hardship
CDS17 Legal Aid in Criminal Proceedings: Statement of Truth
 
Old versions of the above forms signed on or before 1st February 2007 will be accepted until 1st March 2007. Forms signed on or after the mandatory date of 2nd February 2007 must be the new version or they will be rejected.
 
The updated versions will shortly be available to download via our On Line update facility within Forms on Disk. Alternatively, update CDs will be despatched to all Legal Aid customers.

Updated Landlord and Tenant Forms 07/12/06
 
We have today received notification from the Law Society which states:

“Unfortunately an error has just come to light in the drafting of the latest edition of the Law Society’s Business Lease”.

 
This affects the "Whole Building" versions for both registered and unregistered Business Leases, which are forms BLS2W and BLS2. Clause 1.4(c) should be followed by:
 
  (d) insuring the property under this lease.
 
The "Part of Building" versions are not affected, which are forms BLS1 and BLS1P.
 
Although this is a small amendment, we have been advised that it is both vital and urgent. With this in mind, we have amended our forms accordingly.
 
The updated versions are now available to download via our On Line update facility within Forms on Disk.

Updated Form - IHT20506 17/10/06
 
We have today received notification from HM Revenue & Customs Capital Taxes Office explaining that they have made errors on their recently updated form IHT205 (2006).
 
In response to their letter, we have now updated our version of the form IHT20506 in line with the corrections they have made to their form.
 
The amended form comes into immediate effect and is available to download via our On Line Update facility within Forms on Disk.
 
Update CDs will be despatched Monday, 23rd October 2007 to all customers subscribed to the Divorce, Family & Probate group of forms.

Advance Information - CON29M Coal Mining and Brine Subsidence Claim Search (2007) 04/10/06
 
The CON29M has been updated in order to combine coal and brine searches. The Law Society have requested that this form be made available from 31st October 2006.
 
The Coal Authority will continue to accept the 2003 edition until 31st December 2006, but will be supplying the new combined coal and brine search form from 31st October 2006.
 
This form will be available to download via the On Line Update facility within Forms on Disk on the 27th October 2006.
 
Update CDs will be despatched on Wednesday 25th October 2006 to all customers subscribed to the Conveyancing group of forms.

Advance Information - Environmental Health Miscellaneous 08/09/06
 
The Mobile Homes (Written Statement) (England) Regulations 2006 prescribe the Written Statement, which has been produced and comes into force on 1st October 2006.

Further Information - Employment Tribunal Forms 16/05/06
 
Further to our e-bulletin Issue No. 72 (October 2005) we have spoken with the Employment Tribunal Service regarding forms ET1 and ET3 and they now confirm that they will ONLY accept their own forms and will reject any other forms that they receive.

Advance Information: Housing Act 2004 20/03/06
 
The Housing Act 2004 is coming into operation on various dates, as is often the case with legislation. Some forms will be prescribed, others we will draft. We are working with the Chartered Institute of Environmental Health and other specialists in the field to produce a range of necessary but non-prescribed forms.
 
Please click here to download our current list of proposed forms. The list is based on available information provided by the ODPM, and is being updated constantly. If you feel that there are forms, notices, certificates etc that you would also like added please advise us by emailing your ideas to housing@shaws.co.uk.
 
These forms will be available electronically and in a paper format. As the number of new forms is potentially quite large, we have decided to include them in our existing Housing Group in Forms on Disk, our fillable software. The normal price for this entire group is £900.00 plus vat. Existing Forms on disk customers will automatically receive these forms free of charge. Land Registry Forms Questionnaire 10/01/06
 
The Land Registry Prescribed Clauses Leases form and associated Guidance Notes come into full effect on 19 June 2006 as follows:
 
First registration of leases
You can voluntarily use prescribed clauses in all leases lodged from 9 January 2006. You can continue to use prescribed clauses voluntarily for first registrations even when their use becomes compulsory for registrable leases.
 
Registrable leases – voluntary period
You can voluntarily use prescribed clauses in all registrable leases lodged from 9 January 2007 to 18 June 2006.
 
Registrable leases – compulsory period
With a few exceptions, the use of prescribed clauses is compulsory for all registrable leases granted on and after 19 June 2007.

Companies Forms Questionnaire Results 03/01/06
 
With regards to the companies forms questionnaire ebulletin that was sent out in October, due to the feedback that we received we have now produced the two new forms below:

88(3) (2005) Particulars of a contract relating to shares allotted as fully or partly paid up otherwise than in cash

Family Form E Update
 
In case you have not yet downloaded the new Form E that came into effect Monday 5th December, we would like to inform customers that this form, along with a number of other Family forms is available for download via the Online Update Facility within Forms on Disk.
 
For your information, there is another forms update for the Family group occurring this month, which is regarding the Adoption legislation that comes into force on the 30th December 2005. An update CD will be sent out to all customers subscribed to the Family group of forms during the week commencing 19th December 2005.

Family Form E
 
We have recently had a number of customers asking as to whether or not we will be providing the new Financial Statement Form E which comes into effect on the 5th December 2005.
 
I can confirm that we will be providing two updated versions of this form, the second being an extended 40 page version.
 
These forms will be made available for download along with the others that come into effect on the 5th December via our Online Update Facility within Forms on Disk. An update CD will also be sent out in due course.

Employment Tribunal Forms
 
We have been informed that at present the Secretary of Employment Tribunals will only be accepting forms made available by the Employment Tribunals Service.
 
This decision currently affects forms ET1 and ET3, which we have catalogued in Forms on Disk as ETC1 and ETR3.
 
The Employment Tribunals Service have made this decision as they would like people to complete the forms online and submit them electronically via their website http://www.employmenttribunals.gov.uk/default.asp, or alternatively download a PDF version.
 
We are currently appealing against this decision, and we will keep you informed of any new information that we receive.

Companies Forms Questionnaire
 
There are new forms that were prescribed by SI 2005/2747 and SI 2005/2746 for the purpose of a company notifying Companies House of the allotment of shares, which came into effect on the 1st October 2005:
 
These new forms are for use in relation to allotments of shares made on or after 1st December 2003. They have been amended to take account of the abolition of stamp duty (except on instruments relating to stock or marketable securities) under the provisions of Part 4 of the Finance Act 2003.

Improvements to Court Forms: Results
 
Thank you to everyone who provided feedback to our Court Form Improvement e-bulletin.
 
The results are exactly 50-50. With that in mind, as there was no overall majority we have decided to leave the court forms as they are.
 
This will mean that you will still be able to write text into numeric fields such as "to be confirmed", however, forms will not be made to auto-calculate, and columns of numbers will not align on the decimal place.

Advance Information: Court Form Update - CFA
 
We have recently been informed that the Law Society has just revised its Standard Conditional Fee Agreement, plus the associated guidance notes.
 
It is intended that the new Standard Conditional Fee Agreement is to be used from the 1st November 2005.
 
We will publish updated information as soon as we receive further details from the Law Society.

Improvements to Court Forms
 
Due to customer feedback we are currently looking into improving our Court forms to make them fully aligned and auto-calculating.
 
These changes would mean that only numeric data will be able to be entered into the calculation fields. For example, if you currently enter phrases such as "To be Confirmed" into the total fields, you will not be able to enter these phrases if we make the suggested improvements to these forms.
 
Please take a few moments to let us know if you would like to see these changes made to the Court forms.

Advance Information: Courts and Landlord & Tenant Forms Update
 
The Housing Act 2004 (Commencement No.3) (England) Order 2005 came into force on 6th June 2005 and brought into effect on the same day section 192 of the Housing Act 2004.
 
Section 192 introduced a new power to make an order suspending the Right to Buy where anti-social behavior is present, this has resulted in amendments to the following forms:
 
N5 Claim for possession of property
N6 Claim form for demotion of tenancy/ suspension of Right to Buy
N7A Notes for Defendant
N7D Notes for Defendant demotion/ suspension claim
N11D Defence form (demotion of tenancy) (suspension of Right to Buy)
N11R Defence form
N119 Particulars of claim for possession
N119A Notes for guidance to complete particulars of claim
N122 Particulars of claim for demotion order/ suspension of Right to Buy
 
Please Note: Existing forms can still be used until the 1st of October 2005, but only for cases that do not deal with suspension of Right to Buy.
 
The amended forms will be made available to all Forms on Disk customers subscribed to the Courts or Landlord & Tenant group of forms as soon as possible.

CIT Form Update Information
 
The CIT - Application in connection with court proceedings, insolvency and tax liability form is being amended in accordance with The Land Registration (Amendment) Rules 2005, SI 2005/1982.
 
The amended version of this form will come into effect on Monday 24th October 2005 and will be released to all of our conveyancing customers shortly before then.

Medical Records Consent Form (2nd Edition):
 
The second edition of the Medical Records Consent Form (MRC1) becomes effective on the 1st of August 2005.
 
The Law Society have informed us that this form will not be rejected if used before the above date. Therefore, this form is now available for download using the Online Update facility within Forms on Disk.

A number of forms under the Tenant's Right to Buy legislation have been amended, and others discontinued, as a result of the Housing Act 2004.

* New Update * - July 2005 SDLT Update:
 
As of the 1st July 2005 we are no longer an official supplier of the Stamp Duty Land Tax forms.
 
Therefore, we are dispatching the official Stamp Duty Land Tax CD from the Inland Revenue along with our new Forms on Disk software update. These update CD's will be sent to all of our Conveyancing & Land Registration customers during the week commencing 27/06/2005.
 
Another Forms on Disk update CD will follow shortly, which after installiation will set all of the SDLT forms as obsolete within Forms on Disk.
 
Please Note: Any Shaw's Forms on Disk SDLT forms submitted from the 1st July 2005 will be rejected by HM Revenue and Customs.

Phase II Inland Revenue SDLT Forms:
 
As of 1st July 2005 the SDLT Phase II forms come into effect. From this date, we are therefore no longer an official supplier of these forms.
 
We will therefore be sending out Stamp Duty Land Tax CD-ROMS which we have obtained from the Inland Revenue to all of our conveyancing customers along with the Forms on Disk software update scheduled for the end of this month.

This month we are pleased to be releasing our new version of Forms on Disk 4.4.4
 
Some of the new features included on the update are as follows:

Advanced Information - Conveyancing PROP8:
 
The Law Society has produced a new form in the TransAction series which is a PROP8 - Seller's Commonhold Information Form.
 
There is a provisional release date of the 29th April. As soon as we receive a confirmed implementation date we will issue this to our customers.
 
The form will be available for download via On Line Update from the week commencing 25th April. We will be sending update CD's out to all customers subscribed to the conveyancing group in due course.

The following forms have today been amended to comply with the recently published SI2005/41:
 
LA117A Application for a personal licence
LA117B Application for a personal licence under s117 of the 2003 Act made by the holder of a justices' licence during the transitional period

LA117D Disclosure of convictions and declaration

The Licensing Act 2003 - Prescribed Forms Information
 
After many months of preparation we are able to supply final versions of our extensive range of non-prescribed forms for use under the Licensing Act 2003.
 
Those forms requiring to be prescribed have not yet been finalised by the Department of Culture, Media and Sport. If you would like to refer to the DCMS web-site you will see that versions of these forms have been made available, but it is being emphasised that they contain errors and that final versions will be published as quickly as possible.
 
We are, of course, very conscious that users wish to have documents which can be utilised from the first appointed day (Monday 7th February). We are therefore issuing the "prescribed" forms as they currently appear on the web-site, purely as an interim measure and will re-issue them to our customers as soon as they have been correctly prescribed.
 
We have ourselves corrected the more obvious typographical mistakes, but cannot guarantee that the forms will not contain further changes when finalised. We regret any inconvenience this may cause but we are sure you will appreciate that this is due to factors beyond our control.

The Licensing Act 2003
 
The Licensing Act 2003 comes into effect on the 7th February 2004 and has far reaching effects on the liquor licensing system in England and Wales.
 
Shaw & Sons have produced an extensive range of forms including those prescribed by the Government and a large quantity which have been prepared in consultation with acknowledged experts in the field.
 
There are over 140 forms in total which will shortly be available as part of our Forms on Disk package.

Legal Aid Forms Update
 
The Legal Services Commission have made adjustments to some of the Masterpack forms due to changes in government policy and legislation. The affected forms are:
 
CLSADM1 Preservation or recovery under the statutory change and request to postpone enforcement
SPAN SPAN Guidance
QRG SPAN Quick Reference Guide
 
These amended forms will be made available free of charge to all customers who are currently subscribed to Legal Aid. Please note that the above forms can be used immediately, and the CLSADM1 becomes mandatory on 31st January 2005.
 
Update CD's will be distributed in advance of 31st January 2005. The forms will also be made available for download via the On Line Update by Monday 17th January.

Inheritance Tax Forms Update
 
The Inland Revenue Capital Taxes Office have released three forms that come into effect on Monday 1st November 2004, as detailed below:
 
C4 (revised form) Corrective Account / Inventory
IHT205 (new form) Return of Estate Information (permanent home in the UK)
IHT207 (new form) Return of Estate Information (permanent home outside of the UK)
 
These forms are only to be used for applications for a Grant on or after 1st November.
 
All customers currently subscribed to Divorce, Family Proceedings & Probate will receive an update CD free of charge. This update will include each of the amended forms, and will be despatched in advance of 1st November.

New PROP Forms Update
It has been drawn to our attention that the new PROP1 form refers to a 'Seller's Commonhold Information Form' which is not included in the Forms on Disk Conveyancing update.
 
After being in contact with the Law Society, we have found that this form is still in draft format, and has not been released by the Law Society. They do not yet have a release date for this form.
 
As soon as we receive further information on this matter we will inform all customers subscribed to this group of forms.

LT121 Update
 
An extra sentence has been added to the LT121 form which is titled "Reversioner’s Counter Notice" from the Landlord and Tenant group of forms.
 
The amended version of this form is now available for download via the On Line Update.
 
An update CD will be sent to all Forms on Disk customers at the end of the month including the amendments made to this form.

EP2 Update
 
We are pleased to inform our customers that the Court of Protection Enduring Powers of Attorney Act 1985 Form, EP2, Application for Registration has been approved by the Public Guardianship Office.
 
This form is now available for download using the On Line Update facility from within Forms on Disk for all customers subscribed to the Courts and/or Family groups within Forms on Disk.

Law Society TransAction Forms

The National Conveyancing Protocol and TransAction Forms have now been amended to cover recent legislation. The new editions of these forms are to be released on the 8th of October 2004, and will be available through Forms on Disk from this date.

 
Forms affected by these changes are:

PROP6 Fixtures, Fittings, and Contents Form
PROP7 Completion Information and Requisitions on Title

Inland Revenue Stamp Duty Land Tax Forms

From the 19th of July 2004 the following forms will not be available through Forms on Disk:

SDLT1 Land Transaction Return
SDLT2 Land Transaction Return (Additional vendor/purchaser details)
SDLT3 Land Transaction Return (Additional details about the land)
SDLT4 Land Transaction Return (Additional details about the transaction, including leases)
 
These forms will be administered by the Inland Revenue after this date and can be obtained and filled in directly from their web site which can be found at  http://www.inlandrevenue.gov.uk.These forms can also can be ordered by calling the Inland Revenue's National Orderline on telephone number 0845-302-1472.

The department of Constitutional Affairs have decided that from Wednesday 30 June 2004 the following forms come into effect - some new, some revised. These forms MUST be used from the implementation date, as there is no period of grace for the old forms.

Public Guardianship Office - The New EP2

The Public Guardianship Office has launched its new version of the EP2 on 14th May 2004. Our version of EP2 is with the PGO and we are waiting for final approval. This form will be available through On Line Update shortly. You can find the new version of EP2 on the PGO website www.guardianship.gov.uk.

The new version of EP2 has been introduced to facilitate the scanning of information by the PGO, who have no immediate plans to convert any of its other forms into a similar format.

The PGO advise that old forms that are in circulation will be accepted for a period of time.
